How Can an Adult Change the Father on Their Birth Certificate
My question involves paternity law for the State of: Texas
My father on my birth certificate is not my biological father. My mother was married to someone else when she had me. She is now and has been married to my father for over 30 years. I would like for my biological father to be on my birth certificate. What can I do?
Re: 33 Years Old Needing to Change Father on My Birth Certificate
It is too late to challenge paternity.
Your biological father would have to adopt you at this point.

I am married with children.

...which doesn't change my answer.
An adult adoption is really the only way you're going to get your biological father's name on the birth certificate. Legal paternity was established 33 years ago - it's far too late to petition the court to challenge paternity.
May I politely ask why this is so critical? What do you think this will accomplish?
Re: 33 Years Old Needing to Change Father on My Birth Certificate
Thank you for answering my question. Aren't I too old to be adopted? I am married with children myself.
I am trying to get a passport and I would like my real father to be on my information as my real father. He is also my emergency contact.
My dad is also afraid that there will be problems if something happens to him after he passes away.
Re: 33 Years Old Needing to Change Father on My Birth Certificate
Nope - Texas family code does allow for adult adoption.
Quote:
§ 162.501. ADOPTION OF ADULT. The court may grant the
petition of an adult residing in this state to adopt another adult
according to this subchapter.
You can click through to the following subchapters, too: right here
Best bet is to have a chat with a local adoption attorney who can help you.
With regards to your passport, when you intend to travel?

Not until next year.
I have another question. If my dad adopts me how would it affect my marriage (legally)?

Ok, you should be able to get things sorted by then.
It won't affect your marriage at all; except if for some reason there is a family estrangement your bio father might have standing to sue for grandparent visitation of your children. Other than that...nothing will change.

Re: 33 Years Old Needing to Change Father on My Birth Certificate
I'm still not following why this has any bearing on your passport. The birth certificate and all the related information is purely to prove you are a citizen and eligible for the passport. Once it is issued it is of ZERO consequence.
