Florida Emancipation
My son is 16 years old, an A student, has a job, and a car. He is estranged from his mother who has joint custondy with me. We are divorced. He has two siblings that I share joint custody but live with her. After a lengthy custody battle the court split the siblings and i was ganted the primary custoduan of him..
Because of the conflict wiith her he wants to get emancipated. We live in Florida and she lives in Alabama. She is very hostle and does what she can to make both of our live as unhappy as possible. I could file the paperwork but my guess she will fight it even though she has a minimal relationship with him.
Does he have a shot at getting emancipated?

Is he currently living outside of the home and fully supporting himself financially?
Do you both realize that emancipation applies to BOTH parents?

He currrently lives in the home. he pays his own way but rent. I was concerned because i do not think she will support it. if she does not support it does is kill he process?

We won't be emancipated if living with a parent. He'd need to be living OUTSIDE the home and earning enough to pay market rate for rent, even if mom fully supported his petition.
