Do Police Need a Warrant for Personal Information on Ebay
I was charged by an officer for selling a stolen good on eBay. I wondering how this officer would have gotten my address through eBay without a warrant. Do they need a warrant to obtain this information? If so would it have been presented to me? Any advice would be appreciated
Re: Do Police Need a Warrant for Personal Information on Ebay
eBay can answer the question for you. There are many ways to obtain a seller's information. The quick and easiest way is to just ask eBay for the info. If eBay claims that it is protected the police can obtain a subpeona/summons/warrant to provide the information. You would not recieve a copy of it because it is a transaction between the police and the company.
Re: Do Police Need a Warrant for Personal Information on Ebay
It's possible that the officer obtained a warrant, but consistent with its TOS there's no reason why eBay cannot (or will not) cooperate with law enforcement. ("You agree that we may use your personal information to ... prevent potentially prohibited or illegal activities, and enforce our User Agreement;")

Not to mention the fact that addresses aren't considered "confidential" information. All they needed was a name or one of any number of pieces of information in order to determine an address.
