I left with a child in another state and my husband was not against. We lived in another state 5 months. My husband first filed for divorce. The first hearing was TEMPORARY EX PARTE ORDET PREVENTING RELOCATION OF PARTIES' MINOR CHILD AND CHILD PICK-UP ORDER . And my husband had a DUI , Domestic Violence. I and my child ran away from domestic violence. I'm on the court said judge my husband had a DUI , Domestic Violence I have proof but judge did not hear me. The judge decided I should return the child in Florida for 30 days . When I asked where is my child will live, because I do not work I take care of the child. Judging told that the child may live with his father. How can a child live with his father when he drinks every day. And how can a child pick up her mother, a child will stress, shock. We now live with my parents and the child his own room. I'll return with the child in Florida and live in a shelter. I do not know how long me and the baby will have so tormented in the shelter. When we arrive in Florida where I need it to be noted that a child in Florida? I am very afraid that when husband know where we are located in Florida, he will want to pick up my child and would do everything possible for this. How do I prevent this. Please help me.

First of all you need to establish with the court system that you are a victim of domestic violence.
Use your local resources such as department of children and families, department of revenue and the free legal aid at your local courthouse. If your husband filed a petition for divorce then you had only 20 days from the date of service to file your answer. Packets to do so (if the petition was filed in tampa, hillsborough county) are available free online at hillsclerk.com or fljud13.org. Read and understand the order from the judge from his ex parte hearing. Did the judge say that you had to return the child to Tampa AND allow the Father to have visitation or did the order just say that you and the child had to return? If it doesn't spell out visitation then keep that in mind when he tries to hunt you down.
When you file your answer with the courts you have an obligation to send him a copy as well. That's the rules of the court. If you truely are trying to avoid domestic violence then make sure you put in your answer that you have been a victim of domestic violence. Like I said use your local resources. How do you expect to support your child if you do not work? Also, if you are in a DV shelter they do have onsite help that can help you figure this all out. I hope all works out for you. Be diligent in keep up with and responding to all petitions/motions in court.

I have a police report DUI and Domestic Violence.
