Shoplifiting Alcohol in California
My question involves criminal law for the state of: CA
The police came to our door and said that our 19 yr old daughter may have shoplifted alcohol and the friend she was with may have shoplifted food. An employee followed them out and got her license plate number. Apparently, they were in and out of the store a few times that evening. He said that she should call him because then a warrant wouldn't be issued. She called and left a message and we are expecting his return call. The officer said they were going to review the store videotapes. She denies the allegation and we do not know who to believe. We know she needs to cooperate and do the right thing with the police, whatever that may be. When he calls, should she request a PD before speaking with the police? Should she say she is not guilty until we get the results of the investigation? If the tapes show her shoplifting can she request a diversion program or is it too late at that point? Should she give the name of the friend she was with? She has never been in trouble before, to our knowledge. Thank you for your help.

She needs to consult with a Criminal Defense Attorney immediately. She will need to be totally honest with the lawyer.
A PD is available only if she is charged, and if she can prove she cannot afford a private attorney.
