It sounds like they intend to try to terminate your ex's custody. Why weren't you considered as an appropriate custodian when they moved your child out of her home?

She is only on a safety plan. They have not taken custody from my ex (yet). Therefore she was allowed to put my daughter where she wanted. I got a letter in the mail today to let me know about the trial on Monday it said that it was a deprivation hearing.

So you don't have any custody rights at all in relation to the child.
I don't have enough information to gauge what might happen at the hearing, in relation to your ex's rights. If the prosecutor in charge of the case will talk to you, perhaps you can get information that way. I would suggest getting a lawyer and trying to firm up your custodial rights, unless you aren't interested in having custody of your child.

I am very interested in having cusody of my child I have and exercise my visitation rights.

It sounds like you already have a custody plan in place, so I am baffled as to why you weren't the chosen perso for her to live with.
It sounds as though your ex is not fit to care for your child at this time and you need to request full physical and legal custody. You can submit a modification on your own, via the court.
I also agree you need to talk to the DA. Unless otherwise states in your custody decree you have the legal right to access ALL personal information of your daughter. This includes, legal, medical, dental, etc. records. They should be providing you with the details of thsi case and I woud petition for at least temporary removal into your home at this time.
You need to do what's in your child's best interest and I understand if you don't have the financial means, but maybe you should discuss that with the DA and see if they can help. Legal aid can take forever to get help from and you may want to see if there are any attorney association that also help low-income people in your area. I knw we have a group that meets every week to answer questions and even take on some cases on an at need bases.

Tell everyone involved that you are ready, willing and able to take custody of your daughter and you want to give her a beautiful life.
Tell the attorney for your daughter, tell the DCFS attorney, tell the social worker, tell the hearing officer.
Speak up. Don't be rude, but be sure they hear you - ready, willing and able to raise my daughter.

They did not place her with me because they didn't remove custody from her they only put her on a safety plan so she got to deligate who she wanted her to stay with. I only have visitation rights. It seems as though they are planning to take her away at least temporarily.
I spoke with my lawyer Friday and he said that he would let them know that I wanted my daughter so I am glad for that. He also said that I would know everything that has been going on with the case by Monday morning.
Does anyone know if she starts school in my county if the court will be willing to remove her to return her to her mother if I get temporary custody.
