Am I Eligible to Become Emancipated
My question involves emancipation laws for the State of: Connecticut
I am 15 years old, about to turn 16, and i live in CT. I am currently attending school. I recently quit a full time job due to some personal issues, and I am looking for a new job every day. My home life hasn't been abusive or neglective, but from my own standing point, I believe that I would do much better on my own. The way that my parents are showing me how to be is NOT the way I want to live my life. My parents are planning on moving to FL, and i strongly disagree with this. I am in a group called the Order of DeMolay, which basically is a young mens group that does charity work, fundraisers, etc. We also practice many skills such as public speaking, civil awareness, and showing how to be a leader. This group gave me loads of advice and help for anything I needed. The other guys in this group have helped me through a lot, and for the last 4 years, this organization has been my life. I do not want to stay with my family. They can drive me insane and i don't want to have to deal with it anymore. Since I was about 13 or 14 years old, I have thought about emancipation, and i think more and more about it as time goes on. Personally, I would say emancipation is in my best interests because i would have more freedom to do what i want, I wouldn't have to deal with my parents yelling at me about my work hours (which they did on a daily basis), and i wouldnt have to deal with the constant stress they put on me about the simplest things. I have talked to one of my friends who has helped me through a lot the past few years, hell, he saved me life. He always gives me his honest opinion, he has never lied to me before, and I know he will always be there when I need him. I talked to him about me being emancipated, and I talked to his mother about it as well. She agreed to me, that if I am to be emancipated, she will let me stay in the extra room in their home for as long as I want, as long as I pay rent, help her with chores, grocery shopping, etc. My friend also has a full time job and he came up with the idea of us splitting an apartment together. Please, can someone tell me if in my situation, able to become emancipated? Thank you.

No, you will not be emancipated from a good home because you don't want to move.

And the very second you open your mouth in front of a judge, s/he will only reiterate what cyjeff said. And won't be nearly as nice about it.
Please read the other posts on emancipation - because you don't appear to actually understand what it means. Emancipation means that you are already living outside of the home and capable of fully supporting yourself. It's about need - not want. It's meant for children who NEED to legal ability to sign a lease, get the power turned on in their name, etc., etc.
It's not for kids who don't want to relocate because they don't like where their parents are moving to.

i dont want to be emancipated because im moving. my parents are assholes, i cant do anything i want, i have enough money in my bank account to support myself until i find a job. my family moving away is a reason i want to because i want to be as far away from them as possible.

Hon, what makes you think you have the right to do anything your parents don't allow you to do?

Not wanting to move with your parents, and not getting along with them, are not likely to convince a judge that it is in your best interest to be emancipated.

Very few emancipations are ever granted, and most of these are granted when the parents are truly incapable of caring for their child or the parents agree to the emancipation. You would have to provide some truly compelling reasons why your parents should lose their parental rights. Have they beaten you? Failed to provide for you? Injured or neglected you in some other way? Be prepared, a court will ask these questions of you. The court may also require an investigation of your claims and your situation. Chances are you will have been moved out of state prior to the conclusion of any court proceedings.
Sorry, but you may have to wait until you are 18 until you can move back.

You seem to have a large feeling of entitlement. You also seem to think I give a squat over your little tantrum.
The law is clear. Not wanting to move because and/or because your parents don't let you do what you want isn't going to work.
Want to tell us what you did to lose TV privileges or what you did that got you stopped from going for a walk?
I will bet you were doing things you were told not to do... and you decided that mom and dad weren't the boss of you.
I assure you that a judge will think you need MORE, not less, supervision.

No. In your situation you do not have a prayer of being emancipated. I'm not being a smartass - I'm giving it to you straight based on the law. Emancipation is NOT granted in the circumstances you are in, and emancipation does NOT mean living with someone else and splitting expenses.
All the complaining about how bad your situation is and how much better off you would be on your own is not going to change the fact that under the law, you do not meet the requirements for emancipation.

Read the threads stickied at the top of the forum or the link cdwjava shared. In Connecticut, among other factors, to qualify for emancipation a minor must be living apart from his parents and managing his own financial affairs.

By the way abuse (and the above doesn't even begin to comprise abuse) isn't a reason for emancipation either. Some other custodial placement is that answer for that.

Could you help me out here? I do have a good home and everything else. I live only with my mother, and she treats me like shit. Excuse my language, but I can't stand it anymore. I am 15. I turn 16 on december 30th. I don't know why, I don't know when, but she started being like this... and it's always been on me. She yells at me CONSTANTLY. She calls herself a good parent when all she does it come home, sit on her butt all day on the computer, on (adult sex finder) and it's so nasty, because she brings these guys over to the house, and she THINKS im alseep and i hear all these nasty things. it scares me honestly because what if the guy is dangerous!? Am I wrong?She always puts me down, and i'm tired of it, i cry all the time because she makes me feel like i'm nothing in this world. like i'm a piece of shit that wasnt met to happen. but let me tell you, i am 10 times smarter than she is. trust me. she never finished highschool! I already have plans, i know what i want to do, i know i cant live with my father because he doesnt even have a place. actually i dont even know where hes at! i know i can take care of myself. i can get a good job. I know one person who is willing to take me in. well actually i know a lot of people but im willing to stay with this one person. no i dont like them. but they know what im going threw and they told me about this, i dont want to feel like im nothing. i want to be encouraged to do the things i know i can do! believe me, i am amazing in the medical feild. im great at math, and everything else. i read a lot. i write books, everything else, but she is always in my way, i already told her i will be alright without her. she's already threatend me to go live with my father BUT WHERE THE HELL IS HE!? could someone just reply or send me a message please? i need help :(

First of all, there are only two states that will even consider emancipating a 15 year old, and neither of them is Tennessee.
Second, in every state, NO reason is good enough unless the minor, of whatever age, has already demonstrated their PROVEN ability to support themself without aid. That does NOT mean lving with someone else - that means showing the judge that you are capable of paying rent (market rate, not a token for living in someone else's house while they pay the bills), utilities, food, clothing, medical care, transportation, insurance, staples and all the other incidentals of life. While you do not necessarily need to be living alone, you do need to be able to demonstrate to the judge that you will not become a burden on the taxpayers if the people you are living with are collectively hit by a bus, or decide to kick you out, or are transferred to New Zealand and can't/won't take you with them. Unless you can prove this (once you are old enough, of course, and assuming that your state will emancipate a minor in the first place) then your reason for wanting emancipation is irrevelant. And no matter what state you are in, it is highly unlikely that you will be emancipated in violation of your mother's wishes.

We'll repeat. Emancipation is not a procedure for getting out of an abusive house. We don't legally sanction the ability to just run away. If your home life is purely abusive rather than just not to your particular liking, emancipation isn't going to happen, alternative placement will occur. As pointed out, talk to a school counselor, or call 800-4-a-child to get someone to talk to about your options.
Emancipation is a recognition of the already living on their own children to allow them to conduct business transactions as adults.

No child will ever be emancipated if their entire reason for leaving a home that puts a roof over their head, food in their belly and clothes on their back is that mom and I fight.
Just won't happen.
Oh, and kid... you aren't a qualified mental health professional. You don't get to make a medical diagnosis regardless of what you read on WebMD.

okay so i've been reading all these threads and i too want to get emancipated. help me out i think my case is different. im 17 years old i live in florida im not going to lie my house is stable. me and my dad always clash heads and for this reason i was kicked out at 14 but came back for my mother. this weekend we got into the worst argument of all time the day after my mom said it is okay for me to get emancipated if i wish ( my father isn't speaking to me for he says im not his daughter) , i have job, my senior year classes are being done online more than 50% done and senior year hasn't started. since i started working i would pay for my own food , school supplies, phone bill etc. i have a friend who is willing to let me live with her if i pay rent and am emancipated. i don't want to waste money on filling for a petition if there are no chances of me winning. i just cant wait another year till i am 18 being in the same house as my father is beyond overwhelming. please help

Your case is not different. BOTH parents must agree. No way around that. And Florida is one of the more difficult states - if you've got a roof over your head, eat every day, and have the basics of life living with your parents, then the court isn't going deem that you NEED emancipation.
