i am in the VA abuse neglect registry because i spanked my son upon my wife request which she admitted in court after his terrible behavior in school and a parents teacher conference now i can no longer work as a cna my wife testified in my behalf and the judged said he saw nothing in the pictures that looked like excessive force or abuse just a slightly red buttock on a biracial fair skinned child what went wrong what do i do now this was form 08 court ended in 2011 i had no record and i love my career but im banned til my records clear

You shoulda hired a better lawyer. Most jurisdictions consider it abuse if it leaves a clear,visible mark. Your spanking did. Why didn't your wife do the spanking? She's allowed to just as much as you are, so long as you don't go overboard. Was this a jury trial or a bench trial? There was obviously enough evidence to convict you, which normally requires more than a single incident. How was this reported to authorities?

my wife said he was unruly and need his father to discipline him becuase he wouldnt listen to her it was a bench trail and my ex wife reported it because her father said if she didnt he would report us both and take our rights so she did it out of fear there was no previous incident neither of us had record she still doesnt and she and my son spoke on my behalf there was no clear visible marks the judge looked and said to the common wealth what am i looking at hear?

There is obviously something you are leaving out. If it was a bench trial and the judge(bench) did not see anything he considered abusive, why did he find you guilty?

because i plead guilty because i did spank my son i never denied it but i didnt abuse him and i had no idea it would turn out like that my public defender told me to plead this way that it was best she was also my lawyer in my other cases i have posted about

You should have thoroughly researched the potential consequences prior to pleading guilty. You stood in court, of your own free will, and told the court that you did abuse your child. You made another in what apparently is a litany of bad decisions and it is biting you in the buttocks.

I wondering how your ex-wife found out about this as it should have been a closed family matter between you, your son and present wife. Your child was obviously taken for an examination from the data I read. It usually gets that far if its a serious matter than just a minor smack bottom.

Are you saying you spanked your child or your ex-wife's request when she has custody of the child. You refer to a wife and an ex-wife and that you are presently married in another posting.

Something does not add up to the point her father got involved and the bottom was still red. How much time elapsed from the time of spanking until someone noticed a red bottom that was reported to the judge. Or did you admit to the judge you only caused a red bottom at the most; I doubt a public defender would tell you to volunteer that information.

A minor reddening of the bottom should usually dissipate in an hour or two. I'm sure it was a day or two before the child was taken in for an examination.
If the child was not examined, then how did the judge know the extent of damage?

Sounds to me you have a lot of things going on and it would be in your best interest to get a counselor or mentor to guide you a bit. You have to tread lightly for awhile. I am sure people may judge you fast given you background.

A CNA is required to take care of people who are quite weak and vulnerable. You need to prove you can. My brother worked his bottom off for 14 years paying child support and the arrears his ex-wife worked up form defrauding the state; and if he can, you can.

When you stand up in court, are sworn in, and testify under oath that you are guilty of abusing a child and describe acts constituting child abuse, what exactly is it that you would expect the court to do other than convict you? You chose to confess to the charged offense and not to go to trial.

That's a tough situation; I am sure they are against you given the way you may present yourself to them and your history.

Would you consider going back to school and getting a proper education so you can write better to make yourself more employable. The army was a great start; were you honorably discharged ? The services were the first place I went for discipline and got off to a career start after 4 years of service. But that was in in the 80's and the most we did was bomb Libya once then. Any possibility for the National Guard ?

I can sense right away you've lived in some tough areas and have already have had a tough life.

The bottom line is, what is done is done and its not really undo-able.

I would want someone better educated and more presentable and with less of life's issues to take care of our ailing elderly population. An patient has to place utmost trust in his or her caregiver.

drugs? i don't do drugs i got my GED im well educated just typing fast i went to college for my cna passed good honorably discharged and got an 80 on my asvab for the army do i seem so ignorant buy my situation or where i live what is it me being judged off my situation? alcohol is a drug but ive been been prescribed more by doctors than ive ever drank in drug comparison i have had a hard life cause i had my first child at 16 and was in the streets that was ten years ago my only true problems are manic depression and add

Get this behind you and find some other work then. You should still qualify for other health care and hospital work to keep your foot in the health care door. Many have had to do it; and being free of drugs makes you a step ahead of many people in this country.

You will just have to work harder than the next guy to get back to where you want to be. If you keep yourself healthy and think long term in a positive manner, you should get there.
