    Can CPS Impose a Restraining Order
    My question involves restraining orders in the State of: california
    well it started last week when i got another call from my sons school ( i get about 3-4 calls a month) saying that he had said a word of the female lower front parts.. mind you hes 7.. i was asked to get pick him up from school. i asked my son what was the word i knew what it was but i wanted to have hinm tell me, he didnt so i repeated the question several times he refussed. So i lost it from stress low work bills and life in general i grabbed the sandel and i smacked his hands till he told me......please note that i love my son to death even though hes not my blood ive raised him since he was 3 months. but hes been suspended from school 3-4 times flooded the bathroom 1st day on kinder lied to teachers bout who he was, stold school supplies and poperty from others has broken property from others and i just lost it. so i smacked his hands just like when i was in catholic school bout 5x on each hand. We had a good talking even joked around we play fight HARD!!! full contact...school then called cps at 115pm and it wasnt even his home room teacher it was the after school teacher so for 6 hours your telling me the homeroom teacher did not see his hands? so cps came out and my wife and i had to sit down and tell whta happend. the police came but i wasnt arrested because child was not in danger,BUT the cps agent sure wanted me to go to jail..the cop said no but he was gonna have to do a report and take pics. the cps agent said i should take anger management and parenting classes but that it was volentary, i signed up for the classes.
    Then my wife said that my mother-in-law was told by cps that i have a RO. but my wife never went to put one in, she was just advised to and was given a paper to do so if she felt like it....so my question is can CPS just put a RO if they wanted. even if i have never hit my kids or wife and have a clean sheet?
    im so scared of loosing my family? and i know cali CPS are big "MAN HATERS". im just scared of loseing it all cause of one mistake...( also take into count that when i brought up my sons school sheet she just said "thats there and this is here".

    The question then becomes: Where is he getting this information? Why does he feel it appropriate to use the word?

    Good. It will not hurt to learn some coping mechanisms, and alternative forms of discipline. You might also learn some way to try and address these obvious behavior issues that have arisen. Perhaps seek the opinion of his pediatrician as there might be a medical reason for his actions (chemical imbalance, ADHD, mental illness, or just an issue of inconsistent or non-existent boundaries).

    CPS can certainly petition a court for a restraining order. However, if YOU have not been served with a copy, then I would have to assume that no such court order is in place or valid.

    If you are served, there will be a court date on the restraining order.

    The boy's mother is the one who will have to deal with most of this as the boy is legally HER son, not yours (unless you have legally adopted him).
