Issued a Summons for a Felony Because of a Video
My question involves criminal law for the state of: Maine
I met up with a friend in a grocery store and bought a gram of weed and the security saw it on camera so they called the police and my friend was arrested with possession of oxycodone when he left the store. The police are assuming thats what he sold me so they are pushing class c felony charges against me for possession also. all they have is a video and no physical evidence towards me. I haven't been caught with anything besides weed before. Also I should add that I wasn't the one that "sold" it on camera either so I'm confused about the role I play in their "investigation". They told me its up to the grand jury to decide if theres enough evidence but is a video really enough evidence to convict someone for this? Neither me or my friend have said anything to the police. They say this video is all they need to bring me into court. is that true? Could this be enough to charge me? I start a job the same week of my court date that's going to get me back on my feet after being unemployed for 4 months now so I need to defend myself from this. Can a judge just make an assumption that I had this on me with such little evidence?

I guess you need to make up your mind. Either you were video recorded during a drug transaction or you weren't.

somebody isn't being honest. I suspect it is your friend and what he is telling you.

I don't understand what you mean I didn't switch the story I said at the beginning I bought from him and wasn't the one who had sold it.

I see. You were buying rather than selling.
Well, tell the cops that. It will probably help your situation so you don't get unjustly charged with selling drugs.

How did this grocery store video get into the hands of police since it was not about shoplifting, etc.
That aside, if you are being charged with selling also, the video may make it clear to the GJ you bought, not sold, depending on how grainy it is, it may be they may not be able to tell.
As long as Probable Cause exists for them to believe you committed the crime, they can vote to Indict you. PC is a lower burden of proof then BRD.
Since the federal constitution mandates a crime, (an offense with possible jail time), be proven "beyond a reasonable doubt", that is the avenue to pursue.
