Bad Checks, False Promises
My question involves criminal law for the state of: New York
Well, my boyfriend used to work at a store where he encountered a regular customer. They got along pretty well, and so when my boyfriend was getting ready to leave for another job, this regular offered him a position with his company as well. It was a non-profit with a good cause, and he offered him a pretty decent salary as well. I figured it couldn't be so bad. Things started out great, fast forward about 3 months and suddenly there are problems with payroll. Suddenly everybody the company works for is getting personal checks and they are all coming back as the bank account is closed. Doing some digging we find out he has been writing bad checks to everyone involved in every aspect of his life from vendors to lawyers to real estate agencies. Fed we file a police report, and is being charged with grand larceny but through our own snooping we have found out where he is staying and all his current info (he changed his numbers and moved out of where he was staying to avoid everyone). Now if we hand this information over to the police are they going to arrest him and hold him until trial? We all know he will run, and I do not want to tip him off and have him disappear again. And if he is arrested and they do find assets will the courts make him settle his debt or are we fighting a lost cause?
Re: Bad Checks, False Promises
If your boyfriend is considered a victim in the offense he can try to get restitution through the criminal case. I can't promise you that the defendant will have the money to pay what he owes to the various people he had defrauded.
