    Will I Be Arrested or Charged for Shoplifting
    My question involves criminal law for the state of: CA
    Got caught shoplifting at walmart.The police did not show up.I did not talk with an officer and I did not get a trespass from the store.I was told I would get a fine $300.00 civil demand letter...settlement form.I called and made arrangments to pay...I have one payment left and I am done with it.But...it has been a month and am wondering...will I get a summons? I was not arrested and no police showed up!!! I called my courthouse and they have nothing on me...I also called my police department...They have nothing on me!!! I have never broken the law and have never been arrested.Police department told me that if walmart had called them...They would have come.If anyone could give me some advice...Just want to get this over with!!!!Thanks:)

    Well, they do have in most states 1 year to file charges.

    But don't forget, courts do get backlogged. I'd say at 3 months, you can heave a huge sigh of relief. Realize how lucky you have gotten off, and don't do it again.

    Note that if charges had been filed - aside from the Civil Demand, you would add in Court Costs/Fines, costs of probation, community service, or anti-shoplifting class; and attorney fees.

    Thank you very much for taking time to post on my topic...Much appreciated:) I will never do this EVER again!!!! I do beleive there are more people out there today that just have a moment of "Lost Judgement" and think...Just once I would like to be able to have something...and whether they get caught or not...They never do it again!!!!

    Keep the paperwork from your payments and ensure that they are done on time. Many of the larger retailers such as Walmart, Target, Kmart, etc frequently pass on pressing charges so long as you comply with the civil demand for restitution because they don't want the hassle of paying an employee to go to court, testify, pull security footage, etc.

    Thank you for the heads up:) I have kept my receipts and have one payment left to make...Will be on time:) This has been a lesson I will never repeat or forget!!! Appreciate all of the input much:)

    It was a month ago. I did not sign anything...and no fingerprints either.

    If your theft has not been reported to the police, it almost certainly will not be. It is extremely rare that a theft with an identified suspect is reported late after the fact, and after the suspect has agreed to pay the civil demand.

    I doubt you have anything to fear from the justice system at this point.
