Dating a Minor Without Parents Consent
My question relates to legal practice in the state of: I am 19 and my boyfriend is 16. I've been with my boyfriend for almost 6 months but his mom's boyfriend hates me. We've been sneaking around with his mom's persmission to hide it from her boyfriend. She had told him we've been seeing each other the other day and said if he sees or finds out we are still seeing each other he will call the police. Can I get in trouble even though he's not his father? What kinds of trouble can i get in? Please i need to know because my boyfriend had to break up with me because of this and i love him so much.

Re: Dating a Minor Without Parents Consent ):
Every state's laws are different, and you didn't tell us yours.

Regardless of which specific state, yes, you can assume that the parents of a minor have the absolute ability to "get you in trouble". Whether that trouble comes in the form of a statutory rape accusation, or a restraining order against you for interfering with parental control, enticing the minor into unlawful activity, contributing to the delinquency of a minor, or other possibilities. Until the child in question is no longer a child, it can be assumed that his parents have ABSOLUTE authority over him, and those who oppose that authority can face civil and/or criminal consequences.

Re: Dating a Minor Without Parents Consent ):
While his mother may have control over him, her boyfriend doesn't have any legal standing in the matter. If he calls the police they are going to ask who he is, how he is related, etc. When they find out he is a third party they are going to tell him something to the effect that his mom needs to file a complaint, but he cannot.

Thank you! His mom had told her boyfriend sunday morning, but she was the one that has been letting us see each other and hiding it from her boyfriend. She decided to tell him because she didn't want to hide it from him anymore. Then when she told him she played stupid and said she had no idea that we were hanging out. But she really doesn't care that we hang out. So i can not get in trouble still? Even if his moms boyfriend calls the cops? No matter how long they have been dating for?

I'm not as sure as the above poster that the cops will disregard a complaint from anyone but Mom. And a lot depends on your state's laws, as indicated, and you STILL haven't told us which one.

Bottom line, with the limited information we have available, it is still quite possible that you could end up "in trouble". In fact, it's not impossible, with the information we have, that under some circumstances you could end up in jail.

I live in Ohio. But his birth mother was giving us permission to see each other. It's just her boyfriend that doesn't want us seeing each other for some ungodly reason? I just don't get how i could still get in trouble if his mother gave us permission.

Re: Dating a Minor Without Parents Consent
Well, now that we know you're in Ohio, we can look up what the age of consent is and see what laws you might be breaking, depending on just what you're doing with the 16 year old. As it is, as long as his mother consents, you're off and running with any little thing your hearts desire. That would not be true in all states, since his mother cannot give you consent to break the law. And in those states, anyone who had reason to think that the law was being violated could report it.

As it is, Ohio appears to be fine with legal adults playing with children.

We don't have sex, so that's out of the question. I just want to know if it is legal to date him even though he is only 16? Even if his mother's boyfriend disapproves of it.

We just go out and spend time with each other, nothing sexual. We sometimes go with his mother to places also.

Re: Dating a Minor Without Parents Consent
The law does not dictate who may date. The law only dictates who may have sexual contact, which is NOT limited to sexual intercourse. A 16 year old may date, non-sexually, anyone his parents or legal guardian gives him or her permission to date.

If at any time the parent withdraws their permission, then he may not longer date that person. No matter how long they mave have dated in the past.

This continues until the minor is no longer a minor, which is 18 or older in every state.
