    Fighting Illinois Seat Belt Ticket
    My question involves a traffic ticket from the state of: Illinois

    I received a ticket for not wearing a seat belt in my small home town, population 700. I explained to the officer that I live in town and was just going down the road to my mother's house, less than half a mile away. I told him I normally wear my seat belt, and asked him not to give me a ticket for such a short distance. He refused, saying he'd checked and found that I got a seat belt ticket a year ago. I got that ticket dismissed because I was working a census job where I had to exit the vehicle frequently. Can I get this ticket dismissed based on the fact that he used a dismissed ticket against me? Also, can I get it dismissed based on the fact that I was going such a short distance? Illinois law provides an exception for
    "A driver or passenger frequently stopping and leaving the vehicle or delivering property from the vehicle, if the speed of the vehicle between stops does not exceed 15 miles per hour."

    You weren't driving a delivery vehicle - you were driving to your mother's house.

    Whether or not he might have let you off if you had a clean record doesn't make you not guilty of the current charge either.
    You can not use the fact that he MIGHT have been lenient against him.

    I wasn't driving a delivery vehicle when I worked for the census either, but my ticket was dismissed based on this exception. It says "or delivering property."

    You admitted already you were guilty, why waste your time and the courts time to save $25 bucks... Just pay it and be done with it, either way its going to come down to under the seatbelt law A) you were not lawfully employeed as a delivery driver or courier, and B) your speed exceeded 15mph. Also the Officer will testify you admitted to not wearing it.... just pay it
