    Should My Fiance Change His Name
    My fiance I-129F has been approved. During his interview he was asked for his passport and the name on the passport did not match the name on the petition. He has been given a 221(g) and in it states he needs to bring proof of the family name used that the petition his approved by. He found historical documents that states his family name and we hired a lawyer to submit his paperwork that proves his identity. Should we change his passport and his national ID card to the name that the petition has been approved under or should we wait and see what direction the US Embassy will give us as far as his name change after we submit the evidence???? Does the name on the approved petition need to match the name on the passport in order to get the visa issued? Will US Embassy issue his visa under the name that is on his passport and not care about the name that his petition has been approved by? Thank you

    He has a lawyer; he should follow the advice of his lawyer. It would be helpful for us to know if you're asking this because he wants to change his name or because he doesn't want to change his name, but I expect his lawyer already knows the details.

    He wants to change his name. BUT, my question is if he does go ahead and change his name and presents himself to the interview with the new name, will they denie his visa? Would they question why he changed his name to match the name on the paperwork that was filed for the petition? He does not have a problem changing his name, BUT this will be done after the initial interview where they questioned his identity because the name on his passport did not match the name on his approved petition. He now has the opportunity to change his name legally, BUT this is all after he has already been to an interview, given the 221(g) and his identity questioned. IF he comes back with the new name, will they question it???
