Assault with a Car
Driver A stops at a red light and sits for a period of several seconds (10 to 15). Driver A gets tired of waiting for the light to change so moves into the intersection where Driver A is hit by Driver B. Can Driver A be charged with any criminal infractions such as assault or assault with a deadly weapon? Are there any other possible criminal charges that can be brought against Driver A other than the minor traffic violation of failure to obey a traffic signal? The actions of Driver A were not intended to be violent and were not specifically targeted against Driver B. But similar to the case of yelling "fire" in a crowd, Driver A knew, or should have known, that their actions could potetially cause great harm to another individual.

It is possible for criminal charges to be filed; whether or not that would be contemplated, what charge might be issued, and the likely outcome would all vary depending upon the facts of the case and the state in which this occurs.
