Do I Have to Evict My Boyfriend
My question involves an eviction in the state of: Ohio
My boyfriend and I lived together and we are breaking up. We live in an apartment and my name it the only on on the lease. He said he is not going to leave that I have to evict him. I am getting two different answers regarding this matter of evicting him and I'm not sure what to do. PLEASE HELP!!!!

How long has he lived there? Does he, for instance, get mail delivered there?

File for his eviction using the proper notice and response requirements of your state or, if have big stones, call the Sheriff and have him arrested for trespassing. Inventory your house and goods that you own by video and if he rips the place up or steals you can add theft and other criminal charges.

You might also talk to your landlord; if your ex is not on the lease then your landlord could evict him for you as an "unauthorized" tenant. Usually evictions name the person(s) on the lease "and all others in possesion," but it can and does sometimes happen where only a specific name, without the generalized "all others," is named on the eviction. If your landlord can do this then it may make it easier; especially with apartments the management generally a) has experience with the eviction process and b) has attorneys either on retainer or on an as-needed contract basis at their disposal to handle these sorts of things.
