Emancipation in Illinois

My question involves emancipation laws for the State of: Illinois
I'll be 16 in November, and I want to get emancipated. My mom is fine with it, and my dad is dead so his opinion really doesn't matter. Since my mom is okay with it, what do I have to do?

no, i get survivors benefits from my dad, and I get more from that than I would with a part time job.

If you're emancipated, you would no longer get the survivor benefits. Plus, you need to ALREADY be living outside of your home and capable of managing your financial affairs.

So what your saying is I can move out when I'm 16 without getting emancipated and my mom couldn't get charged with child neglect or anything?

Where exactly are you moving to? With whom?

hopefully into government funded housing, like maybe two blocks away from my mom, and with my best friend.

You may have a hard time trying to convince a court to emancipate you to have a government agency take care of you (your housing)

they dont take care of you. they provide low income housing (apartments) to people.

That pretty much guarantees that the court will not emancipate you.

okay thanks. and yes i've read some of them but i didn't come across any of them in illinois in which the parent was fine with the child being emancipated.

Let me try this again.

In order to be emancipated, you need to prove to the court that you are capable of supporting yourself financially. Government housing is not supporting yourself - that means the taxpayer is actually supporting you.

Emancipation isn't about 'want' - it's about need. It's about minors who, for no fault of their own, need the ability to legally sign a lease, keep the power turned on, and those adult things. It's not about kids who want to play room-mates with their besties.

Are you working? What about school?

If Mom allows you to move out, she may face charges of child neglect. May. Not necessarily "will". But she is essentially abandoning a child.

Oh - and no government housing agency will rent to a 16 year old.

If someone is providing you with government subsidized housing.... that means you needs the government to help take care of you because you need them to provide your housing.

Unless of course, you can afford market rent for the type of apartment you are attempting to rent

Carla, I work in Cook County and it is very hard to get a judge to emancipate you they simply dont do it very often because they dont want to see anyone ruin there life at a young age im not saying that is you but in the majority of cases it simply does not work. That being said you have to show the judge proof that you can support yourself financially (pay stubs) as far as food and housing go, and that you are currently attending school with good grades and will promise to continue your education at least high school. Best bet if you can try to tough it out for the next two years then go off on your own, if it simply is not possible for you to tolerate can you stay with a relative nearby that your mother would be ok with?
