Bought a Stolen Bike - What Do I Do
My question involves criminal law for the state of: ONTARIO CANADA
Hi I bought a bike not knowing it was stolen from some guy off of Kjijiji (online classifieds). It turned out it didnt fit, so I posted to sell it and some other guy bought it. Turns out it didnt fit him either... so he posted it, and the cops found the ad arrested him and took the bike.
This guy is now calling me to get his money back..
what do I do? Other than the moral thing to do by giving or splitting the money, what legal advice could you give me?

give him his money back and go after the guy that sold it to you.

I cannot find the guy who I originally bought it from. He deleted his ad, and I do not have his number.

well, I guess you give the guy that you sold the bike to his money back and keep trying to find the guy you bought the bike from so you can make a demand or sue him if you ever find him.

He may have deleted his ad, but my guess is that the service has a complete record of the ad. You provided the information about the seller - the date of the ad, its general content, how you came into contact with the seller, where you purchased the bicycle, etc., to the police?

Turns out I did find his original ad... now I have his phone number, and his apartment building address... still don't have his name though.
ad has proof with pictures and date of posting. Where can I go from here.

You can refund the money to the guy you sold the bike to.
then, you can contact the guy that sold you the bike and make a demand for the return of your money. If he refuses, consider suing him.

This is like playing a game of Hot Potato. You need to keep passing the hot potato along, because if it stops in your hands, you get burned.
The police are going to get your name from this guy because you sold him a stolen bike. The police are going to come to arrest you next because you were the last person with the bike. You need to get the guys name that sold this bike to you so when the police come knocking at your door to arrest you, you can tell them the guys name that sold the bike to you and let him get arrested instead.
Remember that I said it a game of Hot Potato, once the police knock on your door, the potato is in your hands, you need to pass that potato along to John Doe so you don't get burned.
