Accident at an Intersection With a Turning Car
My question involves a traffic accident in the State of: New Jersey
I was behind a car that was stopped at a stop sign, with their left blinker on, and I pulled up to the right to make a right turn, came to a stop, and then the other driver decided to make a right turn, and without looking (visibly had a piece of paper in front of their face) turned right into the driver side of my car....she was stopped when i pulled up on the right, and I was stopped when I was hit...
Re: Who is at Fault for This Accident
were you each in separate lanes?
Re: Who is at Fault for This Accident
Technically there is only one lane going in our direction
Re: Who is at Fault for This Accident
What exactly is your question?
Re: Who is at Fault for This Accident
so, you drove outside of the lane and put yourself in the way of the legal traffic flow, right?
while I suspect they might be ticketed for failure to signal, I see your action as what caused the accident. If you had remained within the legal driving lane, this would not have happened, regardless of what the other driver did.
Re: Who is at Fault for This Accident
It is illegal to go around a car if there is one lane of traffic. If a cop sees you, they will ticket you and yes.. you were in the wrong. In court, you will be at fault.
