    Ex Stating He Has No Money to Pay What He is Supposed to in Our Divorce Decree
    My ex and I divorced 3/11/2010 in Cuyahoga County Ohio. My ex is now stating that he has no money to pay the credit card debt in both of our names, and pay half for the following: tuition for our children, braces for our children, pay into an account for college for our children and pay for extracurricular things that he has paid for in the past, all of which he is supposed to pay per our divorce. I know I have to take him back to court, but what will the judge do and is it worth my time if he states he can't pay. He is working at the same job he has been at for 5 years and I think he built up more debt since our divorce and that is why he is having trouble paying his debt. He also has a new girlfriend and stated he could not pay shortly after he started seeing her. We have 3 children that live with me and I pay for most of their expenses, home, food, medical insurance, clothing. He gives me $600 per month in child support for the 3 children.

    We do not know about his income or assets, or why he is claiming financial hardship. If he has the same income as he did when he agreed to the divorce settlement, I expect that the judge will remind him that he's obligated to live up to his end of the deal.

    In a smaller yet similar manner, my attorney filed a Motion to Show Cause, and my ex agreed to contempt of court, but signed an agreement to purge himself of it. When he didn't follow through with it (he paid 1/2 of one payment), I was told that it was again on me to file against him. I was under the understanding that if I took him to court for it one or two more times, then the judge might garnish his wages.

    Does this sound accurate?
