    Can the Mother Remove the Father from a Birth Certificate
    I live in TN and we found out that my sons 19 month old is not his biological daughter. Can the mother take his name off the birth certificate? He did the test to see if child is his but he still wants to be her dad. Son and daughter-in-law getting divorced. He was also in process of adopting the 3 year old and mom stopped 1 week before came final, he has raised her since she was born. Is there anything he can do about that.

    With regards to the adoption - nope. If Mom doesn't agree and changes her mind, there's nothing your son can do.

    Was the 19 month old born after they got married?

    no she was born before he signed a Parebtal acknolegment of paternity

    Under Tennessee law an acknowledgment of paternity can be rescinded within sixty days. See Tennessee Code Sec. 24-7-113(c). After that, legal action is required. If your son was married to the mother, raised the child as his own and wants to maintain his paternity, he has a good chance of maintaining his parental rights through the divorce case.

    Mom's child from a prior marriage, though? He's unlikely to get access without the mother's (or that child's father's) consent.
