Payment Agreement After Receiving Summons
My question involves collection proceedings in the State of: Michigan
I am being sued for credit card debt. I was in the process of generating an Answer to the summons when I received a phone call from the debt collector that is suing me. The debt collector has agreed to a payment plan and also stated that the suit will move forward until the debt is paid. I am still within the 20-day period given by the court to respond. What is a proper response to the summons given that there is now a payment agreement between me and the debt collector?

The payment plan is to be completed when? Is it confirmed in writing? Does the writing include a promise by the creditor not to seek a default if you make timely payments, or is the creditor willing to commit in writing to an extension of your time to answer?

I plan to pay more than the minimum monthly requirement so I expect to have it paid off in approximately 8 months, perhaps sooner. The agreement was made by phone, however, the collector had also indicated that paperwork outlining the agreement will be mailed to me. My concern is that I won't receive the paperwork in time for me to send a copy along with my answer. If that turns out to be the case, what would be an appropriate answer to the summons, specifically if I don't have the paperwork to "back up" my claim?
If I do receive the paperwork in time, what would be an appropriate response?
