Changing Child's Name From Disinterested Father's
my daughter is 3 1/2 years old the first six mos of her life i tried everything to get the father involed. He cares nothing for her and wants absolutly nothing to do with her. Me and my husband would to give her our last name. But we cant afford it. I asked him if he could help with the money end of it and he said that if i ask him for any form of money he will ask for custody. He even said he doesnt care but when its his turn for her she can stay at his mom's. i havent recived any child support. I asked him to keep paying it but i would stop enforcing it if he didnt claim her in any way. and he agreed. but last week he had yet another child and in the paper he claimed her as a daughter, i want to change her name and just get him out of our lives but i am not sure how when we cant afford it. we are military and i know if we go through military legal it would be cheaper but we still cant afford the adoption. so i was wondering about just changing her last name?

Name change laws vary by state, as do adoption laws. If the biological father would constent to step-parent adoption, generally speaking it shouldn't be either particularly costly or difficult. If he consents to a name change, that should be pretty easy.

i am in NC and he is in MO. But what would be the easiest and cheapest? if we change her name does that make him lose his parental rights? And what are the steps to get a name change? The father said the will sign his rights away the second the paper is infont of him as long as he doesnt have to pay a penny. Is there anyway i can make some of the cost go to him since i have never recived child support even when it was enforced. I know thats alot of questions but i appreciate the help

Start looking at the laws in whatever state has jurisdiction over the custody issues. A simple name change has nothing to do with his parental rights. It's your motion, so you would pay the cost.
