Name Change of Minor in Georgia
My question involves name change laws in the State of: Georgia
My husband and I have permanent custody of our grandchild (2YRS). I need to file a name change petition. At this time I have signed and notarized consent forms from both mother and father. I need to know if I still need to have the parents served with petition. Locating the mother for service is a problem unless I could serve her myself. She won't let us know where she stays and only meet me to sign consent. The father is not a problem. Also, if I need to run notification in paper of her county, do I need an order from the judge to do so?
Re: Name Change of Minor in Georgia
When you file a legal action you are required to serve all interested parties. If you cannot find mom to effect service you can ask the court for leave to serve her by other means. Typically you file your name change petition with the court, and the newspaper of record will help you create the classified ad announcing the petition based upon the content and case number from your filed case.
