    Is CVC 21718a a Point Violation
    My question involves a traffic ticket from the state of: California.

    Hi,
    I just got a ticket recently, which is CVC 21718A
    21718. (a) No person shall stop, park, or leave standing any
    vehicle upon a freeway which has full control of access and no
    crossings at grade except:..............


    I Parked my car on the side way( totally off the freeway) with engine turn off and emergency light on. It closed to the Toll of the bay bridge. I parked there because I was tried and I wanna take a break and ask my friend about the driving direction.

    It charged for $234, I searched on the web, I didn't find anything about if it's a point violation. On DMV's website: http://dmv.ca.gov/dl/vioptct.htm
    21718 doesn't show up as a point violation. Does anyone know about this?
    If it's not a point, I will just pay the Fee; otherwise, I am going to fight it through TBD, since I already have one point on my record. Thanks!

    According to page 16 of the UNIFORM BAIL AND PENALTY SCHEDULES ~ November 2010 Edition, a violation of 21718(a) carries one violation point.

    My bad... http://www.courts.ca.gov/xbcr/SID-B5...011_jcbail.pdf (last column on page 16 shows a "1" which denotes "1 violation point").

    While a judge/commissioner cannot deny your request to attend traffic school simply because you opted for a TBD or a trial, he/she is under no obligation to grant your request at that time. Some judges do, others don't!

    In other words, the only way for a sure shot at traffic school, is by pleading guilty, paying the fine and the traffic school fee and submitting the completion certificate on time!
