Can I Get Emancipated at 17 in Indiana
My question involves emancipation laws for the State of: Indiana
I have parental consent to get emancipated because my dad wishes to move across the country and I want to stay near here and he's fine with that. He has some kind of heart failure and isn't expected to live much longer in any case. He will be selling our house soon to move. I'm 17 and I will turn 18 in five months. I have the means to support myself, as I have over ninety thousand dollars in the bank currently in a trust fund which I do believe I would have access to after being emancipated, which would be more than enough to live off of until I'm able to find a job. I could rent an apartment. I'll be finishing high school and such. So, do you think that will work? And that this is an acceptable plan for living?
Also, if this does work, would I have any trouble moving into Michigan?

If you have parental permission to move out, you may do so, no emancipation required.
Which is perfect for you, since Indiana has no statutory provisions for the emancipation of minors.

(5) Empowering the child to consent to:
(A) medical;
(B) psychological;
(C) psychiatric;
(D) educational; or
(E) social;
services.
(6) Empowering the child to contract.
(7) Empowering the child to own property.
(c) An emancipated child remains subject to the following:
(1) IC 20-33-2 concerning compulsory school attendance.
(2) The continuing jurisdiction of the court.

sounds like you wouldn't have any trouble being emancipated. Sounds like you need to contact your local juvenile court to get the process started.

I understand your position, but you may deeply regret not spending that time with him.
Besides, in 5 months your petition is not likely to be heard and ruled upon.

Yes, my dad is dying, but I haven't any regrets about leaving home. I've already come to terms with it, and the people I have here are more important to me. It would be in everyone's best interests if I stay here, moving back after his death would be costly to my sister.

I suggest dogmatique is likely correct with a timeline. Is there any chance of just staying with friends until you turn 18? It would be much easier.
and how would what you do be costly to your sister? How does she come into the picture in such a way that your actions would affect her finances?

That could be a possibility.but what do I do when I need papers signed for school and such?
And it affects my sister in that if my dad dies she is supposed to be my care taker.

Your dad could give a friend's family authority to enroll you in school, take care of medical expenses, etc. It would be easier and less costly than emancipation, and would take much less time. You'll be a legal adult in 5 months - it may well be easiest just to wait it out.

I may be moving in with my friend who is 19. Would my dad be able to give her that authority or no, and how would we go about getting that done?
