Shoplifting but Fled
My am in some serious trouble but I need help. I know what I did was wrong but I don't need a lecture.
I am in ny state. I was in a major department store and as I was leaving a uniformed security person and two people wearing regular clothes came towards me. I knew what it was for, so I began to run. One guy tackled me but I was able to kick him off. Another guy tackled me and they began to throw punches telling me to stop resisting. I have no clue how but I wriggled free and ran to my car and jumped in. Suddenly the back window shattered. The security guy threw his handcuffs at my car.
I was able to get away, but I'm not sure if they got my plate. I have talked to a lawyer and he said I should turn myself in and then make a claim for my window. He said I will probably be found of a summary offense which is better than a misdemeanor.
What am I looking at fines wise and penalty wise. The lawyer and I have a mtg on Monday I just want to be prepared. I have not been charged yet.question involves criminal law for the state of:

We don't know what your charge will be. You may learn, for example, that the security guard reports that you tried to run him down and that you're being charged with aggravated assault or assault with a deadly weapon. Work with your lawyer.

And I estimate the employee's chances of getting your license plate number approach 100%.

And you are likely on tape inside the store....and possibly the parking lot battle may be on tape, as well. And that can zoom in on your license plate.

Had you simply fled, you attorney would probably be right and you'd only be facing a summary. You chose to not only flee but physically assault the LP agents as well. That may earn you the misdemeanor shoplifting charge as well as assault/battery charges.
It was highly unprofessional for the LP to throw their cuffs at your vehicle and some serious corrective action is warranted, not that you'll ever know. Did the cuffs remain in the vehicle so you can prove what happened? If so, you might be able to go after the store for the damage. Not sure how well it will play out in court though, since you were fleeing after committing multiple crimes. A good lawyer might win as it is not a reasonable reaction.
