Will Judge Issue a Pick-Up Order
My question involves a child custody case from the State of: Alabama
My son's mother moved without notice months ago. We have a contempt hearing scheduled and I have started the publication process.
After spending three months glued to the computer, I finally found her. She is over 270 miles away from the child's home state. My lawyer said he could ask for an emergency hearing if she is found. Can he also ask the judge to issue a pick-up order for the child. That way I can go to the sherrif in LA and have them serve her and turn the child over to me?
Re: Will Judge Issue a Pick-Up Order
Your lawyer knows the full details and status of your case, and has access to the custody order, and we do not, so realistically speaking you need to ask your lawyer what the judge is likely to do. It's certainly reasonable to request a custody order you can use to effect the immediate taking of custody if mom is served and doesn't appear at the emergency hearing.
