Union Refused to Arbitrate Unfair Termination
I was employed by Safeway grocery in Roseville, CA and working under union contract. I had to take time off for a surgical operation on my wrist. Upon my return to work I was given the hardest assignments within my department. A month after my return to work I was terminated for working 30 minutes overtime without authorization. I did not work overtime and when I asked for a copy of my time sheet I was given a forged, revised, and inaccurate copy of time worked rather actual copy from time clock. As a dues-paying union member, I looked toward my union to represent and vindicate me. The union's position, without seeking further information from me, was that Safeway had the right to terminate and refused to seek arbitration. I applied and began receiving employment insurance benefits. Safeway appealed and lost at a hearing. My wages while employed by Safeway were paid by direct deposit and I have yet to receive any wage/hour statements for the final 8 months of my employment although I have made numerous requests.
I believe that I was discriminated against because of my age (52), a female, and my medical condition. I most certainly believe that Safeway and the union owe me for mental anguish I have suffered, loss of income and self esteem, and punitive damages.ARE THERE ANY LAWYERS WILLING TO TAKE THIS CASE call Tami 916-410-6455 Has anybody else had similar problems and won a suit against Safeway.? The rules of this site prohibit the referral of specific attorneys, and reputable attorneys do not troll message boards looking for clients. You would do better to contact your state Bar Association, your local Legal Aid, or any law schools in your area, for referrals.
