Son Got Ticket for Running a Stop Sign That I Watched Him Stop At
My question involves a traffic ticket from the state of: California.
#1: My son received a ticket for running a stop sign that I phyiscally watched him stop at.
#2: The officer wrote him up and put down the wrong intersection and street name.
#3: My son had a passenger with him that can also testify to the fact that he stopped.
#4: The intersection on the Ticket doesnt even have any stop signs. Verified by photos for court.
#5: Does the officer have to show us his dashboard recording if there is one ?
#6: How could we/me go about helping my son get the charges dissmissed. The court date is the 29th of april 2011.
#7: FYI, my son was taking me to the VA hospital as I am a disabled combat veteran and I have the paper wrk from the hosptial to show we did infact end up and the ER:
Please help, as neither my son or myself can afford it. I'm on a disabled pension and living on food stamps and my son take care of me and goes to college. So we have NO income to pay wrongful ticket. It would be a different story if he had really run the stop sign, but he didn't.. Need some solid help here please.

Sounds like the officer was not paying attention very well and that your son should be able to make a case for reasonable doubt without much difficulty.

Most vehicles in CA do not have video. If there is one, your son can request it via discovery. He can also suggest any reports, notes, or other documents generated by the officer related to the stop.

Best way would be to hire an attorney. Absent that, have him call his witnesses and present his photos ... though, the officer might testify as to the correct location at trial and that would make the photos largely irrelevant. But, fi you and the passenger are convincing enough, maybe that will be enough.

That does absolutely nothing to show that he did not run a stop sign. This is not even worth bringing up.
