Can I Get Emancipated

:confused:My question involves emancipation laws for the State of: Texas

I'm 16 years old, my family has alot of problems and I'm always caught in the middle. There is not one day my mom and I don't fight. I fight with everyone, I know there is a reason but none of us get along. My family has never been able to get along. I have alot of thoughts i don't want. I have been wanting to get emancipated but don't think I can. I have money coming into me, I babysit and stuff. But I have enough money to make it on my own, I applied for more than one job and im waiting to hear back. Im in a school that helps you get the last of your credits. I missed a coule years of school for a medical problem. I have a place of my own, it's in my name but can I have a friend move in? Not to help but she's not doing good. So, can i be emancipated without having a legal job yet? Ill have a car in a couple of weeks. Can i be emancipated and have a friend move in, without them paying anything?

Yes. I don't live with them. Them, and my 4 other siblings live with my grandparents.

So..are you currently living by yourself?

You have to prove that you're CURRENTLY able to fully support yourself. What kind of job do you have that can pay full market rent, utilities, food, clothing, health insurance, transportation, sundries....?

I have money coming into me, I am about to start working at Mcdonalds. The place i have is cheap. It's not that much to live there. Yes im living by myself.

According to Texas Family Code 31.001(a), you may petition to become emancipated if you are self-supporting and managing your own financial affairs.

You will have to have one of your parents sign the petition. You will have to explain why emancipation is in your best interest, keeping in mind that "best" is what the State of Texas thinks is best, not what you think is best.

You may have another person living there, but if they are not contributing to the household, that would make it harder to prove you are self-sufficient.

And remember, this is a petition to the court. It is up to the court to decide whether to grant the petition.

If you think you can live totally on your own by working at McDonald's, you need to rethink that. I know where Denton is, BTW, and it's not all THAT cheap. Can you pay for everything? Rent, utilities, cell phone, internet, transportation, car insurance, medical insurance, groceries and staples, dry cleaning, etc.? AND to go school and get decent grades? Not unless the "money you have coming to you" is many thousands.

Plus, you have to have HISTORY of doing so; not just "I'm about to start".

BTW, if you've read any of the threads on emancipation, all of this has been covered a zillion times.

Why do you NEED to be emancipated?
