Filing a Lawsuit After a Discharged Bankruptcy
My question involves bankruptcy in the state of: New York
My bankruptcy discharged in 2006 and I'm now involed in a lawsuit as of 2010. Will my bankruptcy interfare with this lawsuit when I win. Can I collect my monies, I filed chap.7. The reason I ask I was in a classaction suit around the time I filed and it was time for payment to everyone and my case was dismissed because they said I need to reopen the bankruptcy and add it in. I asked the lawyer and she said I did not have any info other that I signed up for a classaction in 2005. Wel that classaction is a loss, but I need to know about this new suit.
Re: Filing a Lawsuit After a Discharged Bankruptcy
We don't know anything about the claim at issue, when it accrued, if it could have been treated as an asset of the bankrupt estate and, if so, whether it was properly reported as an asset when you petitioned for bankruptcy.
If this is entirely a post-discharge matter, then the discharge shouldn't have any relevance.
