Thanks for all of your help. I am confident the DA knows what they're doing. It doesnt seem fair that there are no Sexual Assault charges, but things like this are never fair.

    Thanks again

    You are welcome.

That just so happens to be the way the Texas statutes are written.

Good luck to you and your wife.

Ok, why did nobody ask how the perpetrator got the OP's wife's e-mail address?? Did I miss something here?

Secondly, to everybody, if a house you are living in is listed with a realtor, NEVER allow anybody to view the house without a realtor present Even if it is your own, it is not advisable. There is no reason to allow it and many many reasons to disallow it.

She owns a company, and works from home. He found out the name of her company, went online, and emailed her through her contact page.

Yesterday the defendant in the case waived his arraignment rights, and an announcement hearing has been set. If the DA decides to offer a plea bargin, will they talk to my wife (the victim) before making this offer?

The prosecutor is supposed to give the victim notice of his or her rights, and then "If requested by the victim, the attorney representing the state, as far as reasonably practical, shall give to the victim notice of any scheduled court proceedings, changes in that schedule, the filing of a request for continuance of a trial setting, and any plea agreements to be presented to the court." Details are in the Texas Code of Criminal Procedure, Section 56.08.

Usually, at what point in the case does the prosecutor contact the vicitm? The Announcment Hearing is set for 2 weeks from now, but we've yet to hear anything from the DA's office. They did send my wife some victim's rights info, which detailed our options for possible compensation from the victim's rights fund (?), but we've yet to talk to anyone regarding the case. Any and all updates I've received have been products of my online research on the county's website.

If you don't think the prosecutor is following the statute, be proactive and assert your rights.

The entire reason I sought out a site such as this is because we felt in the dark throughout this time. It looks as though many of the court activities currently taking place as simply standard "technicalities". When we go online and read "REQUEST FOR NOTICE OF INTENT TO OFFER EXTRANEOUS CONDUCT UNDER RULE 404B AND EVIDENCE OF CONVICTION UNDER RULE 609F AND EVIDENCE OF AN EXTRANEOUS CRIME OR BAD ACT UNDER ARTICLE 37.07" although its probably just basic information gathering, we still dont KNOW for sure. We will contact the Prosecutor again. I'm learning that the more information I can put in front of my wife, the easier it is for her to get on with her daily life. Without sites like this, and the online records, we would have no reason to believe they even filed a case.

    Thanks for your help
