Husband Vanished During Divorce, How to Continue
My question involves a marriage in the state of: CA
My parents are in the process of getting a divorce. They have just finished filing their disclosures but have yet to complete the marriage settlement paperwork.
We had intended, in the division papers, to assign the house and credit card debt to my dad. He stopped paying for the mortgage, so the house will foreclose in coming months, and he has accrued $70,000 of credit card debt.
However, he disappeared. He sent an email to his clients saying he had left the country to "take care of business," but I doubt he will ever come back. Is it too late to enter default? How can we finish the divorce without him here and with no knowledge of how or where to find him? Is there any way we can avoid his debts?

Maybe it's a good idea if you allow your parents to work out their legal issues on their own, and you... you just deal with your own issues. Children (even adult children) have no business interfering in their parents legal affairs. If your mother is asking you to get involved, then direct her to the nearest legal aid.

Thanks for the advice, but that's not what I'm looking for. My mom works 7 days a week to keep us afloat since we weren't getting any child support and hardly has time to sort out the legal issues. It's also my problem because if we are forced to declare bankruptcy I'll have to drop out of school. Her attorney is demanding payment if we ask for any more help and we can't afford it so I came here.

You won't have to drop out of school if you're forced to declare bankruptcy. I'm assuming you're an adult, yes?

Yes, and most of my financial aid is in loans. That's not the problem though - all I want to know is if we can finish the divorce without him.
