I did not check NJ, the online laws are not that great to surf.
In my state though, if one is an accomplice, they can either be charged under the Complicity statute OR as the Principal.
The civil suit seems far fetched as coming up with a valid Cause of Action, but that is a wait and see.

needofhelp01: you might instead worry about what makes a person an accomplice in New Jersey. I.e., worry about whether you ought to be found guilty rather than what the penalty might be.

Not related to this case.
It was from different store, different time.
It was expunged a year ago.
