    Can a Salaried Employee be Fired for Working Less than 40 Hours
    My question involves employment and labor law for the state of: New Mexico

    I am a salary non-exempt employee and I was just seperated due to reporting to work late and not annoting it on my time sheet. Even though I worked over 40 hours each week. The only time I worked under 40 hours was one week when I was out sick. I notified my supervisor of this by email but forgot to turn in a leave slip, but she overlooked it also. Can a salaried non-exempt employee be fired for this reason?

    Any employee can be fired for this reason, regardless of their exempt/non-exempt status.

    why would you think a person couldn't be fired for showing up to work late? Salary is only a method of calculating pay. It has nothing to do with your obligations to your employer. If they say you have to be on time, you need to be there on time. It really is that simple.
