    Proving Other Side's Lawyer Is Lying
    Ohio. In a contested divorce that is dragging. Have several letters written by x’s attorney that contradicts his affidavits and motions presented to Court? Realizing opposing counsel must be at court for discussions with Judge, any reason I couldn’t or shouldn’t make copies and show Judge opposing counsel's lies? There are letters he wrote his client and letters written to opposing counsel that contradict statements like he has tried to make a settlement, wants to avoid going to trial, doesn’t know about certain prenup, etc. I’d like to get this over and get his attorney out of the way. His advertisement is “family law, mediation” but then “100% of practice is litigation”. Are majority of attorneys embarrassed by these guys? :o

    Be prepared for the judge to frown on entering letters from opposing counsel to his client into evidence. This is privileged information (attorney/client confidentiality) and the court would want to know how you got it.
    If you believe the attorney has done something ethically wrong then you need to file a grievance with the County Bar or the Ohio Supreme Court. As for the letters written to opposing counsel -- was this your counsel? Where is your counsel now? If opposing counsel is NOT your counsel then this seems not to have anything to do with your case. And hence is not relevant. The advertising issue is governed by ethical rules in Ohio.

    If you believe the attorney has done something ethically wrong then you need to file a grievance with the County Bar or the Ohio Supreme Court.

    I'll file a grievance with the Supreme Court. When should I do this?

    As for the letters written to opposing counsel -- was this your counsel?
    Yes. My counsel sent me most correspondence.

    Where is your counsel now?

    I have new counsel.
    My sarcastic comment about advertising not relevant to anything. Thank you.

    Thank you. I read it downloaded the complaint form.
    What ever action taken by disciplinary counsel will not make any difference in outcome of this case right here and now. This counselor instucted him to dissipate what might be considered marital assets and urged him to trial. Counselor suggested to his client that opposing counsel refuses offer of settlement when in fact he has not provided any factual financial statements or acknowledged real property is marital property.

    It is unfortunate for I know it was his intent to do this. I believe he knows I cannot do anything about it because of the confidential relationship he has with his client. I am discouraged. :confused: But try to remember this is supposed to be difficult to encourage settling differences to support marriage.
