My question involves paternity law for the State of: Colorado
I have a question about name change of a child. I am a mother who has a child who is 5 who carrys my last name. The reson why is while i was pregnant her father would call me tons of ugly names and say the baby isnt his. the day after i had her i filled out the birth certificate i was tempted to put her last name as his but thought about it and decided on my last name i also named myself as her mother and was told i had to name him as the father which i did when he showed up that after noon i told him to look at the document he did and signed it never saying anything about the baby not having his last name. a month and a half later he established paternity and child support was ordered. a few months after that he got a domestic violence charge so i was awarded sole decision making responsibility and he got supervised visits the last 4 years of her life almost 5 years he has had a poor track record last year he had 110 available visits and showed for 44 of them and 6 of them were where he showed for about a hour but left bc he got mad bc our daughter didnt want to play with him. he was also ordered to pay 50% of what it cost out of pocket for medical dental and vision cost. he does not help me pay them i have told him about these bills and he said its not his problem. he now get unsupervised visits as of Jan of this year. there are several issues that we have had sence the unsupervised vists started the main on is that i had to get DHS involved because he was not giving her miralax which is ordered by a dr and a asthma inhalor which is ordered by the dr i had to take her to the ER bc she got sick when i asked him about it he said yeah im not giving it to her so i filed a report about it. but my question is he is now taking me to court to have her last name changed from mine to his what are the chances of that happening. i have been basically her sole provider sence she has been born i have also been through thick and thin with this little girl never left her once and he has been in and out of her life sence she has been born. for very selfish reasons. can you give me some information on how the judge will handle this please
