My question involves a credit report problem in the State of: PA
I have a company coming after me for invalid debt. It involves a contract that was cancelled over 9 years ago. Last year, a collections company started coming after us. I explained everything to them but they keep on.
Our credit reports show this as new debt even though the original transaction was in 2001 and it was cancelled in 2002.
I disputed the information with the credit bureau and it remains. They "verified" the data. How do they verify inaccurate data? Don't they have to show proof?
What can I do now? They've taken the old so-called debt and are stating on my credit report that I owe new debt and split the one account into 3 accounts.
The telephone rep at Experian stated that every time they add a charge to our account, it renews the debt but that doesn't make sense. With that theory, any company who rebills you with added charges would never have a statute of limitations.

no, it does not refresh the aging by them adding a charge to your account unless it was because you incurred additional debt due to your actions. Per the FCRA, they can report a debt for 7 1/2 years after first delinquency. If you have made no payments or charges to the account, it should not show on your CR any longer due to the date of delinquency, unless there is a judgment involved. Then the SOL for reporting the judgment varies based on the life of the judgment.
Failure to correct mistakes on your CR once notified by the consumer is a violation of the FCRA.

Thank you so much for the information. I have found an email from the company late last year that shows that they are asserting that I went delinquent on 1/1/04 (even though it was cancelled in 2002). I called Experian and asked if I can send in proof and she said yes I can, but that doesn't necessarily mean that they will remove the items because the collection company refused to remove it.
I have been reading up on my rights but this feels like brick walls at every corner. Thank you for the links, I'm going to continue my research. I'm going to send the invoice in anyways and hope the credit bureau does their job.

it's not a matter of the creditor refusing to remove it. If you dispute the validity of the debt or the timeline, the CRA must investigate. Now, if the creditor lies and says there have been payments or such later than there actually has, the CRA can choose to believe them without any real fear of repercussions. The creditor is the one filing fraudulent statements at that time. There is a way to deal with the creditors. I'll have to do some research to find it thought.
One thing you can do is attach a note to your credit report disputing the report and why. That is something the CRA must allow.
