    Possible Non-Biological Father Signed Birth Certificate
    My question involves paternity law for the State of: Florida

    Does this mean it is too late to ask for paternity testing if I have (and always have had) doubts that this is the true father?

    There is also an established child support and visitation order in with this person.

    At this point, the child has a legal father. The time for the mother to have challenged paternity was at the time the child support/visitation case was in the works. Now, unless another potential father comes forward and establishes himself as such, including taking over child support, the court won't care even IF the current father isn't the biological one. The court MIGHT entertain a petition from a father who can prove paternity, depending on the child's age, but it isn't going to take a child with two parents legally responsible for the child and knock it down to one. Any petition now would have to be filed by a potential father.

    She is 2 1/2. So I can have joe shmoe come forward and say he thinks he's the potential, would they test joe or both joe and the "legal" father?

    They would test only Joe Shmoe.

    Testing isn't going to be done on the person who is already the legal father. Period. Neither he nor you contested it at the time. He's already established as the father, so that part is over and done. The only people who get tested now are those people who step forward and claim to be the actual father.

    not necessarily trying to "accomplish" anything. Just trying to understand the mess of a final judgement I have. Thank you
