    My question involves criminal law for the state of: Arizona.

    I was caught trying to take a $20 necklace from Sears. Two plain clothes LPs stopped me and took me to the you're-in-trouble-room. They said I was being sued by Sears and would receive a thing in the mail, would have a court date, and would need to call a detective. They said instead of waiting for a police officer to show up, they would do a T.R.A.P.. Photos were taken, I was fingerprinted, and allowed to leave, with a ban from all nationwide stores. They didn't explain much.

    I've read many conflicting things, and was wondering,

    • Will I have to pay the fine that comes in the mail? (I've heard only a court can agree on what I must pay.)
    • Am I still at risk of going to jail after I pay the fine?
    • If I pay the fine, will I still have to go to court? And why, exactly, am I being summoned to court?
    • If/when in court, can I plead guilty and request a diversion program, or will I need to plead not guilty and request a representative to negotiate for me?
    • What is my best option in order to put all this behind me without a record?
    • Why do I have to call a detective?
    • What is T.R.A.P.?
    • Approximately, what will all this cost me, and what sort options do I have as far as payment plans?

    As far as T.R.A.P. goes there are some jurisdictions in Arizona that allow the retailer take all of the information, release the suspect and then submit the info to them. The police then issue a citation, usually by mail.

    Will I have to pay the fine that comes in the mail? I've heard only a court can agree on what I must pay. They were talking about the Civil Demand. You should expect the demand to be $150.00.

    If I pay the fine, will I still have to go to court? And why, exactly, am I being summoned to court? The Civil Demand is separate for any criminal charge. Why are you being summoned to court - really? You stole merchandise. And if you concealed the merchandise and tried to leave the store - Arizona has a concealment law. You don't have to leave the store.

    Why do I have to call a detective? Because when you get the criminal notice in the mail - it will instruct you to do so. You will have to appear for fingerprinting and photographs.

    Two plain clothes LPs stopped me and took me to the you're-in-trouble-room. I wouldn't be so flippant about this.

    I'm sorry for being so ignorant.

    More specifically, I meant, if they already took my information in the room the isn't a surveillance room and I'm not sure what to call it, and if I already paid the fine, what more is there to be done? Why am I going to court; what will happen?

    And is TRAP the same as being arrested? What is a citation?
