    Eavesdropping At A Disciplinary Meeting
    I am a administrator for a school district in Illinois.
    It has been brought to my attention that while I was having a discipline meeting with one of my employees, her union rep, who was present, recorded the meeting with out my consent or knowledge.
    After futher checking, the 2 union reps have also recorded my staff meetings, my conversations in my building and office.
    I reported this to the district and the comment was, because they are union, there isn't much we can do.
    I am wanting to file a civil suit against the union and the employees. Where do I start and what do I need to know or am I waisting my time?

    You can review the Illinois eavesdropping statutes on the Illinois General Assembly website. There are criminal penalties for surreptitiously recording conversations, unless an exception applies.

    For filing a civil suit, at least if you want a lawyer to work on a contingency basis, the attorney will have to believe that you suffered damages which can be recovered through litigation.

    My response:

    Regardless of the law in your State, have you read the Union contract for this subject? It may be allowed by contract; i.e., the recording statutes may have been affirmatively waived.

    I have read the contract and no where does it state anything about recording.
    I have also read the law and in Illinois it is prohibited and is a class 4 felony per offense and damages are available to the victim.
    I can prove damages.
    Right now all I have is several witnesses.

    Okay, since you know that it's a violation of the Penal Code of your State, have you reported this matter to your District Attorney's office for investigation?
