Cavity Search on Side of Road
My question involves police conduct in the State of: CALIFORNIA
HELLO EVERYONE, a female friend of mine who is on parole in LA county was pulled over by the LA county sheriffs department and was given a cavity search on the side of the road. My question is are they aloud to give you a cavity search on the side of the road in town in broad daylight where people could see as they drive by? Im under the impression that being on parole you dont really have alot of rights but i would think that if the sheriff had enough reason to think that you r hiding something in your cavity arent they supposed to take you to the station to do the search. pl;ease any info will be helpful and by the way she did have drugs she was hiding but still didnt they violate her civil rights as a human being
Re: Cavity Search on Side of Road
she has a public defender at the least that i no of. she called me today from jail and told me what happened and said that her civil rights were violated and asked me to find a civil rights attorney. before i spent all my time looking for an attorney to take the case i thought i could ask a question on here and get an honest answer but i guess not because there r rude senhior members that think everything is a joke

First, let us define what you mean by a "cavity search." When *I* hear the term, I'm thinking strip search, bend over, a visual exam, and a search warrant. Well, in the case of a parolee you might not need the search warrant, but you still need to leave it visual and you should have at least articulable reasonable suspicion.
What REALLY happened?
If she did not get naked and gave up the dope, then it was not a cavity search. If they stripped her down on the street corner, she likely has a big payday coming when she sues the agency involved. But, understand that what she TOLD you about what happened may be far different than what the officers' say happened.
Re: Cavity Search on Side of Road
that you are true. she didnt really go into deep details but she did tell me the officer made her take out her tampon and spread her cheeks where they found the drugs

I find it hard to believe they did that on the side of the road. That sort of thing is typically conducted at the office or jail if done at all.
If they did something that stupid on the side of the road, then the officers are moron and deserve to be fired yesterday. And, if true, the agencies will likely settle quickly and out of court.
Re: Cavity Search on Side of Road
so 1 last question is it possible to point me in the right direction to get her some legal assistance

She is facing criminal charges. Her first priority is legal counsel for the criminal charges. You can either call around for some private attorneys if she can afford to pay. Or, she can ask for publicly appointed counsel at her arraignment.
Re: Cavity Search on Side of Road
but without the cavity search there would be no criminal charges. please understand me she was breaking the law and everyone nos when u play that game u r gonna lose and i no that

That's why she needs a criminal defense attorney. That attorney can review the law enforcement agency reports and determine if there is grounds to file a motion for dismissal or not.
But, even if there was wrongdoing by the officers with regards to WHERE the search was conducted, that is not a guarantee
that any evidence will be dismissed.
Hence, the reason for her to have an attorney.

Too bad this forum doesn't allow Thumbs Up votes for some posts (and vice versa).
