    Ticket Indicates the Wrong County
    The officers involved in this case falsely filled out forms stating the stop happened in a different county, this being an adjacent county. The only reason they did this was to make their job easier. Is this grounds for getting this case thrown out? Charges were, aggravated unlicensed operation 3rd, no seat belt, no regestration, uninsured, uninspected and switched plates.

    It doesn't matter where the STOP occurred, so much as it matters where the infraction was seen occurring.

    I was in a totaly different county, inventory of vehicle was taken in a different county car was towed to that county. These cops decided it would be easier for them to go to a closer courthouse.

    Do you want to bother to indicate what state we're talking about. In a lot of states, the county is by and large immaterial.

    New york, long island specifically. State troopers made the stop

    It states on the citations that it was affirmed under penalty of perjury and was signed by an officer.

    The correct avenue to approach is a change of venue motion .... you could ask for a dismissal too in the same request/motion. Write up your motion & your memorandum of law & properly file it.

    Is this a TVB hearing? I think that they still examine these types of motions -- you can visit/call them and ask. They will ignore your request of course but you would have good grounds for an appeal. Post a link to the memo, less any identifying information. We'll comment on it.
