Retail Theft Record for a Minor
A couple months ago a friend and i shoplifted some underwear (about $40, yea expensive underwear) from a department store in pennsylvania. the police arrived and they took us to the station, scared the crap out of us, the whole nine yards. the store, of course, pressed charges. the police called it a summary offense and said it was about equal to a speeding ticket. i wound up paying about $300 in fines and doing 40 hrs of community service. i always understood that your record clears upon turning 18, but the police told us that because it was retail theft, it wouldn't clear. someone else told us that it would be cleared to employers' and could only be viewed by the police. i turn 18 at the end of the month and want to know if i'm going to have to pay for this stupid mistake that happened when i was a minor for the rest of my life.

    My response:

Underwear? You stole underwear? Couldn't you have stolen something more interesting? Since when do minors steal underwear? Is there something mentally wrong with you? Nobody steals underwear!!

CD's, perfume, refrigerators, televisions, cash registers, hot water heaters, Prom dresses, Gucci watches - - but, damn!! Underwear?

    My response:

Yeah, it's really weird, ain't it? You'd think they'd be a little more savvy about what they steal. I mean, what's wrong with a Kleenex box, or bottle of dish soap, or paper towels?

I cannot believe the infatuation some people have with undergarments. What the hell is going on? Oh, the stupidity of it all!!

Treatment of juvenile criminal records varies by state. You did not describe the state in which the conviction occurred.

And one poster thought we were awful! I guess stealing underwear is a girl thing just like boys have MIP's/Public urination in college towns, what I think is really gross is women who go into a big store with self serve shoe departments and switch their old shoes for a new pair and walk out with them.

According to the Juvenile Law Center, you must petition to have a Pennsylvania juvenile record sealed:
    Quote:

Quoting Are juvenile records automatically expunged after some period of time?
No. To have juvenile records destroyed, the subject of the record or any other concerned party must petition the court for its expungement. The court will expunge the records if it finds any one of the following:
    1. A complaint is not substantiated or is dismissed.

    2. Six months have passed since the final discharge of the person from supervision under a consent decree and no juvenile or criminal charges are pending.

    3. Five years have passed since the final discharge of a person from commitment, placement, or any other disposition and since that time no further charges have been filed or are pending.

    4. If the subject of the record is 18 years or older, the prosecutor agrees to the expungement, and the court has considered the following:
    the type of offense

the individual's age, history of employment, criminal activity, and drug or alcohol problems

adverse consequences that the individual may suffer if the records are not expunged, such as obstacles to entrance into the military or higher education

whether retention of the record is required for the purpose of protecting public safety
