Interstate Compact
My question involves criminal law for the state of: GA to CA
In 2010 I was sentenced to 5 years probation First Offender. I have served without violations, paid my fines, and have had no problems whatsoever. I am living in Georgia and have my entire life. My husband got a job transfer to CA recently, and I am 7 months pregnant. My Probation Officer said I could go, and we started the transfer process the 1st of March, however, Interstate Compact has repeatedly replied back needing more information. It is now the 1st of April, has my process not even started? I have done everything possible in my power to comply and work with everyone, and I hope after the last attempt that they have everything and can begin the transfer process, for I am nearing my due date. I just have a few questions...
My Probation Officer said CA must reply within 48 hours. What does this mean? I read it took up to 45 days. Could this be for a Mandatory transfer, rather than Discretionary? Do I qualify for Mandatory?
I also have no blood relatives in CA, would my husband qualify as family?

Re: Interstate Compact
If the process was initiated such that some information was conveyed and there was a reply back for more, it's reasonable to say that the process was started. What we can't tell you is when it will conclude with, one would hope, approval of the transfer.
You can read California's statutes on The Interstate Compact for Adult Offender Supervision here. I don't know what provision your probation officer has in mind. Consider asking him.
Your husband is a member of your immediate family.

Re: Interstate Compact
Follow-up... my probation officer called me 3 days after we resent my paperwork to California. CA accepted me. I went to his office, signed some paperwork and got a travel permit, and was told I could move. I was given 2 days to get to California and report to the state probation, by phone. The CA probation told me she would tell GA that I reported on time and my transfer process would begin. She said it would take about 45 days and that I wouldn't be assigned a probation officer until the transfer process began.
