Tenant in Chapter 7 Bankruptcy, with a Bad Landlord
I have been in my current lease for almost a year and am having difficulties with my landlord. He has come out to the house many times with his maintainance man to repair the problems but does a terrible job. The chimeny has been leaking the entire time and mold has formed in there, the water comes in the front door the int rains, the front door can't be opend from outside because the lock is broken, there are no screens on the windows and most cant be opened anyway, the air conditioner does not blow in my bedroom (living in Florida this is a problem), the toilet is no bolted to the floor, and the tile is falling off the walls in the shower, there is no drywall behind the tile so it lets bugs in, ect... For $850/month plus utilities, plus an $850 security deposit this is pittiful. I am tired of dealing with this. He has no problem coming to see where his rent is when the mail delays the check a day. One day late and he is calling and at my door! At the beggining of the lease he would never get the rent checks in the mail and came every month. I did not understand why untill this month when my roommate mailed the checks and he did not get them. The address typed on the lease is not the right one. I told him the address that I was mailing to and he told me that he had never heard of it before and did not even know where that zip code was. He is full of crap and just worried about getting his money, not fixing anything.

I filed chapter 7 about 5 months into the lease and I am now completly broke and cannot afford to pay this last months rent in addition to, a security deposit and first months rent on a new place. What can I do? He told me today that he has no intention of ever giving back the secutiry deposit because even though there is no damage showing now, some might come up a few months after I leave. I have 20 days left in this house and will be moving out in probably a week.

If you sent a check, and the check wasn't cashed, why don't you have that money to pay your rent?

    My resoponse:

My landlord for some reason or another wants the rent on the 15th of the month. I know, go figure. Who would have a bill on the 15th? One should try having viral meningitis and spend 4 months in the hospital. It is a splended time, under that haze. You cant move, or use the restroom, or eat, or even talk. It will only cost you your income for a year and a half, plus 80% that your PPO pays, plus an extra $334,695 in medical bills. Oh don't forget, while you're in and cannot pick up a phone and call your creditors, they repo your stuff.

Evidentally if you are a really funny guy who has nothing better to do than sit on the internet and be so helpfull to others, this will never happen. Sorry folks, I know that you want it too.

    Your response:

I don't like being attacked because I am so funny, and you are wrong, and, and, and I am just so mad right now that I am having trouble typing correctly.

Things happen and that is why there is this site. If I wanted to be the center of everyone's laughter I would go to the Comedy Zone and tell jokes. Thanks so much for your professional advice. I am sure to recomend this forum to all.

IAAL's point, stated as it was, is that you didn't actually state a question.

Do you want help? Because at present you're the snarkiest person in this thread.
