Statutory Rape Laws in Florida
I am 18 going to be 19, 11/20 my girlfriend is 15 going to be 16, 11/03 now her father says hes going to press charges on me for Satutory rape and I just want to know if it's legal for us to be dating when shes 16 and i'm 19 (and if it's legal right now and iv'e been reading around alot around this and alot of people say it's legal but i'd like to have an answer directly) also if I were to get charged what might happen:confused: :confused:

Well, if you have nt had sex with her and you have not touched her anywhere that her underwear cover (safe rule of thumb there) prior to her turning 16, there are no grounds for statutory rape as you have not commited a sexual act yet.
Age of Consent laws do not apply to dating. They only apply to sex. There is no age of consent to dating. IAAL is right about him trying to get a restraining order over contributing to the delinquency of a minor but thats a tough sell. That crime is defined as influencing a minor in a way that encourages to act in a way not appropriate for their age. It can be argued that dating someone withing three years age difference without having sex is age approriate activity for a 15 year old.
I say for a 15 year old because the moment she turns 16, she can legally consent to sex with anyone between the ages of 16 - 23 in the state of Florida. Given that She will be of legal age to have sex with you, it will, thereafter, be seen as appropriate for her to date you (seeing as how she can legally sleep with you.)
Furthermore, the DA files the charges, not her father. They will decide if it is worth persuing. In all likelihood, there probably isnt any proof that you did anythign they can charge you on before she turns 16 yet. Keep it that way.
In anycase, IAAL is right that you are playing with fire. This will not turn out well if you are having these issues with her family (unless her mother likes you. then its just an over protective father).
Anyways, dating someone that close to your age is not illegal, to my knowledge so you should be fine, legally speaking.
