Assault and Battery

I live in a fairly new community owned by a couple of friends of the family so my roomante and I rent from them.............I got home from out of town on a wed. about 2:30PM............I noticed that there were construction workers working on the side of the townhome on a retention pond..............when I started unpacking my car from the weekend I noticed that the construction workers were using our water hose outlet.............I called my roomate to find out if he had given them permission to do so and he said no................so I called the bouilder and asked why the construction workers were using our water and he said he had no idea they were so he said "I will call you back and find out what is going on"..............In the meanwhile he told me to turn the water off since is my water that I am paying for it and therefore deserve the right to so..................I turned the water off and continued to unload my car and when I came back outside they had turned the water on again so I went around the back of the townhome to see if I could talk to any of them and I then saw that they were using the outside electrical outlet also.............my landlord called me and told me she had heard and she said "just unplug the outlet and turn off the water, they cant do anything to you".............well I did, and as I was pulling the electrical outlet on the back of the house one of the construction workers came from behind and grabbed my hands and pushed me off to the side and proceeded to call me names refering to me as rascist against the poor people?????............................aperantly they were using the water to wash off their boots and equipment..........I then started to walk towards the screen porch and another worker grabbed me and pushed me agaisnt the fence and punched me in the stomach threatening me not to call the cops since he knew were I lived he would come back...............he then picked me up and threw me into the retention pond...........I tumbled down and got all mudy and thats when my neihgbor heard me screaming so he came out and called the cops..............the worker had punched me so hard in the stomach I could not stop vomitting and spitting out blood...............I filled a police report and went to the hospital................this guys know where I live and I do not feel protected anymore.............they police officer said I could file a restraining order agaisnt them and that will keep them off................what to do next??????????????and what happens next??????????????

So far, it has been reported to the police and you have had yourself treated at the hospital. I would recommend providing a copy of the medical reports to the police (in most states an assault resulting in injury that requires hospitalization is far more serious than another type of assault). Additionally, you might consider the restraining order. Without it, the parties involved can hang out, taunt and intimidate you, and do what they want so long as they otherwise obey the law.

What happens next will depend on your state's laws, and whether the DA decides to press charges against the other men or not.
